ADA compliance can prove to be tricky

In the U.S., compliance with The Americans with Disabilities Act (ADA), makes employers legally unable to unfavorably treat a qualified job seeker differently just because he/she has that disability. (U.S. Equal Employment Opportunity Commission).

Please note the above word, “qualified.” Unfortunately, some employees create job descriptions to circumvent certain issues. (For example, if a company does not want to hire anybody with a chronic back issue, the job description may read something like this: The prospective employee must be able to safely lift items up to x number of pounds.)
